General Terms and Conditions

§ 1 Scope and provider
(1) These General Terms and Conditions ("GTC") govern all contracts concluded between May Holding Baleares S.L., Polígono 12, 07687 Manacor, Spain (hereinafter "Mega Jump Park" or "we") and consumers or businesses (hereinafter "Customer") relating to the purchase of tickets, vouchers or other services.
(2) Tickets are sold online at https://megajumpparktickets.eu. General information about the park can be found at https://www.megajumppark.eu. Tickets are also available on site at the box office.
(3) "Consumer" means any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.
(4) Any deviating, conflicting or supplementary general terms and conditions of the Customer shall only become part of the contract if and to the extent that we have expressly agreed to their validity in writing.

§ 3 Conclusion of contract
(1) The presentation of tickets, vouchers and other services on our websites does not constitute a legally binding offer but rather an invitation to the Customer to submit an offer (invitatio ad offerendum).
(2) By clicking the button "Buy now", "Order with obligation to pay" or a similar button in the order process, the Customer submits a binding offer to purchase the tickets in the basket.
(3) We confirm receipt of the order immediately after submission by e-mail. This confirmation of receipt does not yet constitute acceptance of the offer. The contract is concluded only upon dispatch of the separate order confirmation, at the latest when the ticket is provided (e-ticket delivery).
(4) The languages available for the contract are German, English and Spanish, depending on the selection made during the order process. We recommend that you save or print the GTC and the order confirmation locally.
§ 4 Prices and payment
(1) The prices stated on the ticket website at the time of order shall apply. All prices are in euros and include Spanish VAT (IVA).
(2) The payment methods available are those shown during the order process (e.g. credit card, PayPal, instant bank transfer, Apple Pay, Google Pay).
(3) The purchase price is due immediately upon ordering.
(4) Any bank, exchange or foreign transaction fees incurred by the Customer shall be borne by the Customer.
§ 5 Delivery and redemption of tickets
(1) Tickets are delivered exclusively as electronic tickets ("e-ticket") by e-mail to the address provided by the Customer.
(2) The e-ticket contains an individual QR/barcode that entitles to a single admission. In case of duplicate or fraudulent use we reserve the right to refuse admission.
(3) Tickets are valid exclusively for the event, date and time slot stated on the ticket.
(4) Vouchers, unless otherwise indicated, are valid for three (3) years from the end of the year of their issue.
§ 6 Admission, house rules and participation conditions
(1) The current house rules posted in the park and published on our website apply. By entering the park, the Customer accepts the house rules as binding.
(2) Stay in the park as well as use of the trampoline and attraction areas takes place at the Customer's own risk. Trampoline sports and comparable activities entail typical sport-specific risks (e.g. falls, sprains, collisions).
(3) The Customer is obliged to follow the instructions of our staff at all times. In the event of violations of the house rules, we are entitled to expel the Customer from the park without any obligation to refund.
(4) Use of certain attractions may be subject to minimum age, minimum height, maximum weight or health requirements.
§ 7 Health fitness
(1) Persons with cardiovascular conditions, pregnant women, persons under the influence of alcohol, drugs or consciousness-altering medication as well as persons with acute injuries or unhealed surgical scars are excluded from participation.
(2) By entering the jumping areas, the Customer represents that no such health restrictions apply.
§ 8 Minors and duty of supervision
(1) Children under six (6) years of age may only enter the park accompanied by an adult supervisor.
(2) For minors aged 6 to 17, a declaration of consent signed by a person with parental authority may be required. This is available on site and may also be downloaded in advance.
§ 9 Liability
(1) We are liable without limitation for damages resulting from injury to life, body or health based on intentional or negligent breach of duty, as well as for other damages based on intentional or grossly negligent breach of duty.
(2) In the case of slightly negligent breach of material contractual obligations ("cardinal obligations"), our liability is limited to the foreseeable damage typical for this type of contract. Liability for slight negligence in the breach of non-essential contractual obligations is excluded.
(3) We assume no liability for cloakroom items or valuables brought along, except in cases of intent or gross negligence. We recommend that valuables are stored in the lockers provided.
§ 10 Photo and video recordings
(1) Photo and video recordings are made in our park for security and, where applicable, marketing purposes. Processing is based on our Privacy Policy.
(2) Should the Customer not consent to marketing recordings, this can be communicated to our staff on site at any time.
§ 11 Right of withdrawal / cancellation
(1) Consumers are generally entitled to a statutory right of withdrawal. The separate withdrawal instructions apply to the statutory right of withdrawal.
(2) Important: For contracts for the provision of leisure services with a specific date or period of performance, no right of withdrawal exists under Art. 103(l) of Spanish Royal Legislative Decree 1/2007 / Art. 16(l) Directive 2011/83/EU. Dated tickets are therefore not subject to the 14-day right of withdrawal.
§ 12 Data protection
Data collected in connection with the contractual relationship and the use of the website are processed in accordance with our Privacy Policy.
§ 13 Applicable law, jurisdiction
(1) The laws of the Kingdom of Spain apply to all legal relationships between the parties, excluding the laws on the international purchase of movable goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the State in which the consumer has his/her habitual residence is not withdrawn (Art. 6(2) Rome I Regulation).
(2) If the Customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the court having jurisdiction over our registered office in Manacor / Palma de Mallorca. For consumers, the statutory places of jurisdiction remain unaffected.
§ 14 Dispute resolution
(1) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.
(2) We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 15 Final provisions
(1) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall not be affected.
(2) Amendments and supplements to these GTC must be made in text form.
